ICCBA Files Amicus Curiae Brief Challenging U.S. Sanctions on the ICC

The International Criminal Court Bar Association (ICCBA) has filed an amicus curiae brief before the U.S. District Court for the Southern District of New York in American Friends Service Committee et al. v. Trump et al. (No. 1:26-cv-06830 (JMF)), a case challenging the sanctions regime established under Executive Order 14203.


The ICCBA’s brief supports the plaintiffs’ motion for a preliminary injunction and addresses the impact of the sanctions regime on counsel practising before the International Criminal Court, including its effects on their professional and ethical obligations, their ability to represent clients effectively, and access to justice more broadly.


The brief also highlights the wider chilling effect of the sanctions regime on the community of lawyers working before the ICC, including counsel who have declined new instructions, stepped back from proceedings or withdrawn from representing clients.
